Privacy Policy
1. Who we are
Latido Care Navigation ("Latido," "we," "us," "our") is a brand operated by Border Marketing Group LLC, a California limited liability company located at 4275 Executive Sq., Suite 200, La Jolla, CA 92037, United States.
This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and what choices you have. It applies to latidocare.com (the "Site") and to the care-navigation and administrative services we provide (the "Services").
2. What Latido is, and what it is not
Latido is not a healthcare provider. We do not practice medicine, make clinical decisions, give medical advice, or provide treatment. Medical care is provided by independent, licensed physicians and facilities in Mexico. Latido coordinates the non-clinical parts of your care journey: information, scheduling, records transfer, travel logistics, bilingual administrative support, and authorized payment administration.
Latido is not a HIPAA covered entity. Because we are not a healthcare provider, health plan, or healthcare clearinghouse, the U.S. Health Insurance Portability and Accountability Act ("HIPAA") does not generally govern the information we hold. We state this plainly rather than implying protections that do not apply. We nonetheless treat health information as sensitive and protect it as described in this policy. Your treating physicians and facilities are subject to the laws of the country in which they practice, including Mexican health-privacy and data-protection law.
3. Information we collect
Information you give us directly. When you contact us by email, telephone, WhatsApp, text message, or an online form, or when you engage our Services, we may collect:
- Identity and contact details — name, date of birth, postal address, email address, telephone number, preferred language
- Health information you choose to share — symptoms, diagnoses, medical history, medications, prior test results, imaging, physician reports, and the reason you are seeking care
- Travel and logistics details — passport or identification details where required for border crossing or hospital admission, travel dates, companion details, accessibility needs
- Payment and billing information — billing name and address, and records of amounts quoted, invoiced, and paid. Full payment card numbers are handled by our payment processor and are not stored by Latido.
- Correspondence — the content of your messages, calls, and documents you send us
- Signature data — electronic signature records for agreements you execute
Information collected automatically on the Site. Our website is hosted on Squarespace, which sets cookies and collects standard technical data such as IP address, browser type, device type, referring page, pages viewed, and time of visit. This is used for security, site operation, and aggregate traffic measurement. The Site does not currently host an intake form and does not process payments.
Information from others. With your authorization, we may receive medical records, reports, imaging, scheduling information, and billing details from your treating physicians, hospitals, clinics, or prior providers.
4. How we use your information
We use personal information to:
- Respond to your enquiry and explain available services, providers, and expected costs
- Assess, with you, whether cross-border care coordination is appropriate for your situation
- Introduce you to, and coordinate with, an independent treating practice
- Transfer your medical records and information to the treating practice at your direction
- Arrange appointments, admissions, travel, and logistics
- Provide bilingual administrative support before, during, and after your visit
- Prepare quotes and invoices, and administer payment on behalf of the treating practice
- Follow up after your care and support continuity with providers in the United States
- Keep records required for accounting, tax, insurance, and legal compliance
- Detect and prevent fraud, and protect the security of our systems
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not use your health information for marketing.
5. When we share your information
With the treating medical practice and facility. This is the core of what we do. To arrange your care we transmit your identity, contact, health, and scheduling information to the independent physicians, hospitals, or clinics you select. Once received, that information is held by them under their own privacy practices and the law of the country in which they operate. We share this information only with your authorization.
With service providers who work on our behalf, under contract and only as needed to run the business: Google Workspace and Google Drive (email, documents, file storage); Twilio (telephone and messaging); WhatsApp, operated by Meta Platforms (patient messaging); PandaDoc (electronic signature); Squarespace (website hosting); and JPMorgan Chase together with our card payment processor (banking and payment administration).
With professional advisors — our attorneys, accountants, and insurers — where necessary and subject to confidentiality.
Where required by law — in response to lawful requests from public authorities, court orders, or subpoenas, or to establish, exercise, or defend legal claims.
In a business transfer — if the business is sold or reorganized, subject to this policy.
6. Transfer of information to Mexico
Please read this section carefully. Latido's model is inherently cross-border.
- Your information will be transferred to and processed in Mexico in order to arrange your care.
- Members of our team who provide patient coordination are resident in Tijuana, Mexico, and access your information from there.
- The treating physicians, hospitals, and clinics are located in Mexico and are governed by Mexican law, including Mexico's federal data-protection law.
- Mexico's privacy and data-protection laws differ from those of the United States and of your home state, and may offer different or lesser protections. Legal remedies available to you may also differ.
By engaging our Services and authorizing us to share your information with a treating practice, you consent to this transfer. If you are not willing for your information to be transferred to and processed in Mexico, we cannot provide the Services.
7. Calls, text messages, and WhatsApp
If you provide a telephone number, you agree that Latido may contact you at that number by call, SMS text message, and WhatsApp regarding your enquiry, appointments, logistics, billing, and follow-up. Message and data rates may apply. Message frequency varies by case.
You can stop at any time. Reply STOP to any text message to opt out of text messages, or tell us in writing at info@latidocare.com. Opting out of text messages does not opt you out of email or telephone contact about an active case. We do not send marketing text messages without your separate prior express written consent.
WhatsApp messages are transmitted through Meta Platforms' service and are subject to WhatsApp's own terms and privacy policy in addition to this one.
8. How long we keep information
We keep personal information for as long as needed for the purpose it was collected, and then for as long as required for legal, tax, accounting, insurance, and dispute-resolution purposes. In practice this means:
- Enquiries that do not become cases — retained for up to two years, then deleted
- Case files, including records shared with a provider and payment records — retained for at least seven years from the close of the case
- Signed agreements and payment records — retained for at least seven years
Copies held by your treating physicians and facilities are governed by their own retention rules, not ours.
9. How we protect information
We maintain administrative, technical, and physical safeguards appropriate to the size of our business and the sensitivity of the information, including access controls limiting case files to personnel who need them, multi-factor authentication on business accounts, encrypted transmission and storage through our vendors, device security requirements for company laptops and mobile phones, and written confidentiality obligations for personnel and contractors.
No method of transmission or storage is completely secure. We cannot guarantee absolute security, and email and messaging apps are not fully secure channels. Please do not send information you are not comfortable transmitting electronically; tell us if you would prefer another method.
10. Your choices and rights
You may at any time ask what we hold about you and request a copy; correct information that is inaccurate or incomplete; withdraw your authorization to share your information with a provider, going forward; ask us to delete information, subject to the retention obligations in Section 8; and opt out of text messages as described in Section 7.
To make a request, contact us using the details in Section 13. We will verify your identity before acting on a request, and will respond within 45 days.
California residents. Border Marketing Group LLC does not currently meet the thresholds that make the California Consumer Privacy Act apply to a business. We nonetheless extend the rights above to all clients as a matter of practice. We do not sell personal information or share it for cross-context behavioral advertising, and we do not discriminate against anyone who exercises a privacy right.
Residents of other states. Several states have enacted consumer health data laws with additional requirements. If you live in one of those states and want to know how they apply to your information, contact us and we will tell you.
11. Children
Our Services are directed to adults. We do not knowingly collect information from children under 13. Where a minor receives care, we deal with the parent or legal guardian, who provides all authorizations on the minor's behalf.
12. Changes to this policy
We may update this policy. When we do, we will change the "Last updated" date above and post the revised policy on this page. If we make a material change to how we use or share your information, we will tell affected clients directly.
